What is the Longshore and Harbor Workers’ Compensation Act?
The federal Workers’ Compensation act known as the Longshore and Harbor Workers’ Compensation Act (LHWCA) provides for “compensation and medical care to employees disabled form injuries that occur on the navigable waters of the United States and adjoining areas.” Longshore or harbor related injuries may occur in the process of loading, unloading, repairing, or building vessels such as ships or barges. The Act also offers benefits to dependents if the injury (or occupational disease) causes the employee’s death.

This Act covers workers engaged in any type of maritime employment, including longshore workers or other persons in longshore operations as well as harbor workers, including ship repairers, shipbuilders, ship breakers, and people who load and unload cargos.
In certain cases, people injured in other types of employment in or near shores or harbors are also eligible for Workers’ Compensation under this Act – and their dependents may be eligible for death benefits.
